Terms of Use

1. ACCEPTANCE OF THESE TERMS

These Terms of Use (“Terms”) govern your access to and use of RebuildAfterStroke.org (the “Site”), including the Recovery Wishlist (the “Wishlist”), operated by RebuildAfterStroke (“Rebuild After Stroke,” “we,” “our,” or “us”).
By accessing, creating an account for, or using the Site or Wishlist, you agree to be bound by these Terms.
If you do not agree to these Terms, you should not access or use the Site or Wishlist.
 

2. PURPOSE OF THE WISHLIST

The Wishlist is intended to help stroke survivors, caregivers, family members, friends, and supporters communicate recovery-related needs and coordinate assistance.

The Wishlist may allow users to:

● create profiles;

● share recovery-related information;

● identify desired items or resources;

● connect Amazon Wishlists;

● communicate needs to supporters; and

● receive assistance from others.

The Wishlist is a communication and coordination tool only.

Rebuild After Stroke does not sell products, process payments, guarantee assistance, or coordinate fulfillment of requested items.

3. ELIGIBILITY

You must be at least eighteen (18) years old to create an account.

Individuals between thirteen (13) and seventeen (17) years old may use the Wishlist only with the involvement and consent of a parent or legal guardian.

The Wishlist is not intended for children under thirteen (13).
 

4. ACCOUNT SECURITY

You are responsible for:

● maintaining the confidentiality of account credentials;

● restricting access to your account;

● maintaining accurate account information; and

● all activity occurring under your account.

You agree to notify us promptly if you believe your account has been compromised.

We are not responsible for losses resulting from unauthorized use of your account.

5. REGISTRIES CREATED FOR ANOTHER PERSON

Many Wishlist profiles may be created by:

● spouses;

● adult children;

● family members;

● caregivers;

● guardians; or

● other authorized representatives.

If you create or manage a Wishlist for another individual, you represent that:

● you have authority to do so;

● the information shared reflects that person’s wishes to the best of your knowledge;

● you will respect that person’s privacy preferences; and

● you will modify or remove information if requested by the individual or an authorized representative.

We reserve the right to remove content if questions arise regarding authority or consent.

6. VISIBILITY SETTINGS

The Wishlist may provide visibility options including:

Public
Visible to anyone and potentially searchable through internet search engines.

Unlisted
Accessible to individuals possessing the direct link.

Private
Accessible only to the account owner.

Users are solely responsible for selecting appropriate visibility settings.

Rebuild After Stroke cannot guarantee that information shared online will remain private.
 

7. USER CONTENT

“User Content” means information, text, photographs, descriptions, comments, links, and other materials submitted to the Wishlist.

You retain ownership of your User Content.

By submitting User Content, you grant Rebuild After Stroke a non-exclusive, worldwide, royalty-free license to:

● host;

● store;

● reproduce;

● display;

● distribute; and

● otherwise use the content

solely for the purpose of operating, maintaining, and improving the Wishlist.

8. YOUR RESPONSIBILITIES

You are solely responsible for User Content you submit.

You represent that:

● you have the right to submit it;

 

● it is accurate to the best of your knowledge;

● it does not violate applicable law;

● it does not violate another person’s rights; and

● it complies with these Terms.

You should not post:

● Social Security numbers;

● financial account information;

● medical records;

● passwords;

● private contact information of third parties; or

● information you do not wish to become public.

9. PROHIBITED CONTENT

You may not post content that:

● is false, deceptive, or fraudulent;

● infringes intellectual property rights;

● violates privacy rights;

● contains harassment, threats, or abuse;

● promotes unlawful activity;

● promotes discrimination or hate;

● contains malware or malicious code;

● impersonates another person; or

● is otherwise harmful to users or the organization.

10. PROHIBITED CONDUCT

You may not:

● create fraudulent Wishlist profiles;

● misrepresent your identity;

● attempt unauthorized access to accounts or systems;

● interfere with Site operations;

● scrape or harvest user information;

● use automated bots without authorization;

● distribute malicious software;

● interfere with security measures;

● use the Wishlist for commercial advertising unrelated to recovery support; or

● use Wishlist content to train artificial intelligence systems without written authorization.

11. CONTENT MODERATION

We reserve the right, but not the obligation, to:

● review content;

● investigate complaints;

● remove content;

● edit content;

● restrict visibility;

● suspend accounts; or

● terminate accounts

when we reasonably believe such action is necessary.

We may act with or without prior notice.

We are not obligated to monitor all content.

12. COPYRIGHT COMPLAINTS

If you believe content infringes your copyright, contact: support@rebuildafterstroke.com

Your notice should include:

● identification of the copyrighted work;

● identification of the allegedly infringing material;

● your contact information;

● a statement of good-faith belief; and

● a statement that the information provided is accurate.

We reserve the right to remove disputed content while evaluating complaints.

13. THIRD-PARTY SERVICES

The Wishlist may link to or integrate with third-party services including Amazon.

Third-party services are operated independently.

We do not control and are not responsible for:

● third-party products;

● third-party services;

● third-party content;

● third-party security practices; or

● third-party privacy practices.

Your use of third-party services is governed by their own terms and policies.

14. MEDICAL DISCLAIMER

The Wishlist is not a medical service.

Rebuild After Stroke does not provide:

● medical advice;

● medical diagnosis;

● treatment recommendations;

● rehabilitation services;

● nursing services; or

● healthcare services.

Nothing on the Site or Wishlist should be interpreted as medical advice.

The Wishlist is not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition.

Always seek advice from qualified healthcare professionals regarding medical decisions.

The Wishlist is not intended for emergency situations.

If you believe someone may be experiencing a medical emergency, call 911 or seek immediate emergency assistance.

15. NO GUARANTEE OF DONATIONS OR ASSISTANCE

The Wishlist is intended to facilitate communication regarding recovery-related needs.

Rebuild After Stroke does not guarantee:

● donations;

● gifts;

● assistance;

● financial support;

● visits;

● communications;

● volunteer help; or

● responses from supporters.

Creation of a Wishlist does not create any obligation on the part of Rebuild After Stroke or any visitor.

16. DISCLAIMER OF WARRANTIES

THE SITE AND WISHLIST ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBUILD AFTER STROKE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

● MERCHANTABILITY;

● FITNESS FOR A PARTICULAR PURPOSE;

● NON-INFRINGEMENT;

● ACCURACY;

● RELIABILITY; AND

● AVAILABILITY.

WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REBUILD AFTER STROKE, ITS DIRECTORS, OFFICERS, VOLUNTEERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

● USE OF THE SITE;

● USE OF THE WISHLIST;

● USER CONTENT;

● THIRD-PARTY SERVICES;

● DONATIONS;

● FAILURE TO RECEIVE ASSISTANCE; OR

● UNAUTHORIZED ACCESS TO INFORMATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

18. INDEMNIFICATION

You agree to indemnify and hold harmless Rebuild After Stroke and its directors, officers, volunteers, employees, and agents from claims, liabilities, damages, losses, and expenses arising from:

● your use of the Site;

● your User Content;

● violation of these Terms; or

● violation of another person’s rights.

19. SUSPENSION AND TERMINATION

We may suspend, restrict, or terminate access to the Site or Wishlist at any time for any lawful reason, including:

● violation of these Terms;

● fraud;

● misuse of the Wishlist;

● protection of users;

● protection of organizational resources; or

● legal compliance.

Termination does not limit any rights or remedies available to us.

20. AMAZON ASSOCIATES DISCLOSURE

Rebuild After Stroke participates in the Amazon Associates Program.

We may earn commissions from qualifying purchases made through Amazon links.

Participation in this program does not influence the resources or services we provide.
 

21. GOVERNING LAW

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
 

22. VENUE

Any legal proceeding arising from these Terms shall be brought in a state or federal court located in Salt Lake County, Utah.

You consent to the jurisdiction
 

23. FORCE MAJEURE

Rebuild After Stroke shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including:

● natural disasters;

● public health emergencies;

● internet outages;

● cyberattacks;


● labor disputes;

● governmental actions; or

● failures of third-party providers.

24. CHANGES TO THESE TERMS

We may revise these Terms from time to time.

Material revisions will be posted on the Site with an updated Effective Date.

Continued use of the Site following publication of revised Terms constitutes acceptance of those revisions.
